lucky4u Posted July 8, 2013 Report Share Posted July 8, 2013 I came to US on H4 visa and applied for H1-B under 2013 quota and received my approval in 2013, then i started searching for a project but I didn’t get till now. Now employer is saying that he will cancel my H1B and I don’t have pay stubs to transfer to other employer. If my employer cancels my H1B, do i need to apply for H4 or still can i still continue searching for a project and once i get project can i move to the other employer. If i move to H4 now and in future if i want to work do I need to apply for H1-B under new quota or can i renew the existing one. Thanks in advance for your help. Link to comment

By LAW your employer has to find a project and pay regularly. From the day your H1 started you need to get paid, file a complain against that fraud employer for not paying you on time. This is the ONLY option you have. Using this complaint you can file transfer and stay legally, if not you will face lot of problems for being out of status. Link to comment
