H1 to H4

Hello,

 

My wife recently was laid off from her job. Her company had filed for her H1 this year and she was approved for it. But due to her lay off her lawyer has informed her that she has until  October 1st to find another job or she will have to go back.

 

As per my information her H1 cycle duration starts on October 1st Until then she is on her F1. 

 

My company also has filed for my H1 but it hasn't got approved yet. My question is can I file for my wife's H4 at this point of time. If yes how do I do it and if no what needs to be done
