OPT Extension Travel and H1B Stamping

Hello,

 

I got my OPT extension on 05/05/2013 and it will be valid for another 17 months.

I am planning to travel to India in Oct'13 and come back in Dec'13.

 

I have H1B application in process - which is currently RFE and we are planning to respond to the RFE hopefully by deadline mentioned.

 

Considering the positive case that, if my H1B petition gets approved - 

 

1. Is it compulsory for me to go for stamping before I come back to US?

2. If I go for stamping, and for some reason stamping does not go through - then can I come back to US on OPT extension as it is still valid. (FYI - I am working as a full time software engineer for one of the start up company - not doing contracting)

 

Considering the negative case, if my H1B petition gets rejected - 

3. Will there be any issue while coming back to US?

1. YES, if you leave before the H1with COS is approved.

 

2. You can come back if you have a valid F1 visa.

Hello how long did it took for your opt extension to get approved. Just trying to find out how long it taking now to get the extension

and also how many days before you should apply for opt extension ?

my current opt ends on Oct 31st 2013 i need to file an opt extension.
