Sujatha_R Posted July 4, 2013 Report Posted July 4, 2013 Hello, I applied for H4 COS after I received an RFE on my h1b transfer. My H1b transfer got approved and I sent a COS application withdrawal request to USCIS immediately. I applied for COS on june 10 and sent the withdrawal request after I received the receipt number on June 20. My question is what if my H4 COS gets processed? is the withdrawal letter considered ignored or will it be processed even after the approval went through? I know that 1s H4 COS is approved I need to stop working since my status becomes H4 and I am not supposed to work on H4 but wht happens to the COS withdrawal letter? Appreciate your reply and help.
pontevecchio Posted July 5, 2013 Report Posted July 5, 2013 You have to wait and see. Most likely the H4 COS will be deemed withdrawn. If the H4COS is approved for any reason you would leave the country and come back on an H1 visa, existing or new .

Ideally the H4 is "withdrawn" so even if USCIS approves the H4 in error I can still work on my h1b since H4 will eventually be withdrawn isn't it? or the best approach will be to take an infopass and ask USCIS official to ask what my next set of actions should be. If they say I can work since H4 was granted in error. I can I guess right?

Sujatha_R Posted July 9, 2013 Author Report Posted July 9, 2013 After I took an info-pass I got the following information: An acknowledgement to withdrawal letter has been sent on july 2nd by USCIS. Now, for some reason if COS gets approved, based on the withdrawal ack I can continue to work on my h1b?, so I don't really have to think about the COS 1s I receive the ack is it?
