PermAuditquestion Posted July 3, 2013 Report Posted July 3, 2013 My 6th year H1B expires on Aug 4th 2013. My Perm was applied on Jan 16th 2013 and got an audit on Jun 26th 2013. My company responded to the audit. Now, is it legal for my company to run my payroll here in US, while i work for them in India?
ss.syam@gmail.com Posted July 4, 2013 Report Posted July 4, 2013 No. It's not legal. Most of the companies allow to run on US payroll for a short period, such as vacation. You cannot file for 1 year extension , since your application for PERM didn't complete first 365 days.
