I'm planning on attending my H4 Visa sometime soon in India and my spouse who is on H1B in USA got passport expired recently, but H1B is valid till 2015. Can I attend H4 visa in India when my spouse passport is expired ? Thank You!!

L2EADGC Posted July 22, 2013 Author Report Posted July 22, 2013 I got my H4 stamping done eventhough the passport of H1B was expired, all the VO asked for is I797 document.
pontevecchio Posted July 23, 2013 Report Posted July 23, 2013 It is possible for a H1 extension to be approved even were the Passport to expire before the end of the extension. The H1 status remains valid. It is only when you return that the I94 cannot exceed the Passport expiry.
