vmaha Posted July 2, 2013 Report Posted July 2, 2013 My lawyer informed me yesterday that recently there are several (he said hundreds) rejections of perm due to mention of standard statement in perm advertisement. It normally say in educational background - "any engineering degree and equivalent". it seems DOL is looking for more narrower description like particular degree names like electrical engineering, computer engineering etc. becuase any engineering degree is wide open. Anyone has experinced this recently?
JoeF Posted July 2, 2013 Report Posted July 2, 2013 That is not surprising. You can't do software development with a mechanical engineering degree, for example. If your PERM has such language, find a better employer and a better lawyer.
cap-gap Posted July 2, 2013 Report Posted July 2, 2013 might be true..we'll know in couple of days..I used to dismiss this type of news but not anymore since the newark airport news.. if it is indeeed true, makes sense..CIS sometimes tries to evolve and close the loop holes..like they did with E-V-V-V^n-C models..

The current statement was - " Bachelor of Science or equivalent level degree in any Engineering field, Computer or Management Information Systems, Computer Sciences, or closely related field. " It seems "any" is objected. This is my second PERM. My first PERM was approved with exact same language too with priority date of April 2008 in eb2. But since I am no longer employed with that company, I have to do again!

It seems "any" is objected. what is ur degree in? the wording might have been created to sound not tailored to your skills.. say if others in your position are performing the job with "any" degree then it should reflect that..in such cases taking away "any" might create problems, if ur perm is audited....

For example my firm (non IT, manufacturing) perm was applied for a position(s) of Design Engineer whose employees had Masters Degree in Mechanical, Civil, Aerospace, Engineering Technology, Engineering Science. Technically a person with any of the above mentioned degree with background in structural design is qualified to do the job. Hence, the position was advertised as 'any engineering degree' with 12 months experience in relevant field. All the perms were approved. So the term 'any' doesn't necessarily mean rejection.

I know every case is different with every new company! I started this post more for reason to check if there are several hundreds rejection of perm recently as lawyer is saying or this is one more standard practice of delaying by employer. this is become a visicious cycle. employers make every efforts to delay processing then employee gets so fed up that once gc comes he leaves the job in 6 months then employer thinks all people do same so he tries to delay processing for next employee even more.

I am here for 10 yrs now. completed one eb2 process and company laid off entire IT dept 2 months before date become current around 2 yr back. PD = april 2008. The company was biggest manufacturing company of UK. now i am doing second eb2 process with same education and exactly same job with another forture 100 company.

Well, USCIS nowadays enforces the laws better. Again, find a job that matches your education.
