Withdrawn H1B petetion

Hi,

 

 

I had my 1st H1B interview on Sep 10th, 2012. VO  had questions about my client letter. He gave me 221g and said they are going to do background check. I got a call from VO and asked me to come for reinterview. They asked me to bring an agreement between the new client and petetioner.

 

I was forced to withdraw my H1B petetion today Jul 1st, 2013. I have submitted new client letter and all required documents. VO said my client looks like he is not going to provide me job and is not reliable company. So they will revoke my H1B or I can withdraw my application. VO said If they revoke my H1B, I may face problems in future so she has asked me to withdraw my application. The withdrawl form contains my name, I797B receipt number, my petetioner.

 

I have no idea what to do now? Is anyone else facing similar problem? Please Help

You cannot withdraw the petition. Only USCIS or the sponsor can revoke it. They may have asked you to withdraw the application for the visa.

So can I take an appointment if I get a job offer with the same petitioner? My petition is valid till 2014. When VO asked me to withdraw, they took my LCA and I797B.

As you said when VO asked me to withdraw, they actually asked me to withdraw my visa application. So in that case can I book a slot and go to the consulate with new client letter? My petition expires in May, 2014. Also VO took my LCA and I797B. Please suggest.

Hmm, first, it was pontevecchio who ansered your question, not me...

The VO was nice to let you withdraw the application. If they had denied the visa, you would have to answer the question on future applications, "have you ever been denied a visa" with yes.

Your employer would have to have a REAL project for you, with client letter, etc. if you want to have a chance to get a visa to work for that employer.

My suggestion, though, is to find a better employer. Avoid consulting companies, in particular if there are middle vendors. That kind of stuff is over by now.
