LuckyBaby Posted June 28, 2013 Report Posted June 28, 2013 Hi, Greetings to all forum members. My situation is below. Me and my wife are on L1 and L2 visa. Our I-94 is getting expired on next jan 26. As I have completed 5 years on L1, my company is not applying for extension ( because I am not eligible for it). Couple of months back, my wife tested +ve for her pregnancy. Her due date is on Nov month end. I know for new born baby we need to apply for passport and indian visa after getting the birth certificate. I am not sure whether we get all those details in 7 weeks. We wanted to have baby here in USA. Please let me know how can I stay here in USA legally till i get all my baby documentation. Thanks,
ge145 Posted June 28, 2013 Report Posted June 28, 2013 You are pushing your luck here Dec time, its slow processing time overall For passport You should make an appointment to be seen at a Regional Passport Agency onlyif: The U.S. passport is needed in less than 2 weeks for international travel The U.S. passport is needed within 4 weeks to obtain a foreign visa Indian consulate it depends on which location u r in US. I applied for PIO card, and it took me 5 weeks to get my kid passport back. btw, please do not think that you have ample time in your hands once ur newborn arrives
cutexing21 Posted June 29, 2013 Report Posted June 29, 2013 Hi My baby was born on Dec 8 2010. He got the PP by Jan 8 2011. His PIO card took another couple of weeks. All in all 6 weeks. They proceeded to India in Feb 2011.
LuckyBaby Posted July 1, 2013 Author Report Posted July 1, 2013 Thanks for youe replies @ge145 , I am living in TN state. I checked here for birth certificate. they told me that it would take 4 weeks. I called PP agency number and they mentioned that , we would get PP in single day satisfying one of the conditions above ( obviously 2 in my case) if we apply by person. And I called Travisa Outsourcing and asked for Processing time of PIO card. they told me that I would get in 2 weeks time. I may get all in 7 weeks. I am thinking to have our baby here in USA. Please let me know if any other sugessions. @cutexing21 Thanks for your reply. Can you please let me know which was your residence when you got those if i am not asking for your personal information. Please let me know if any other suggessions . Thanks,
ge145 Posted July 1, 2013 Report Posted July 1, 2013 I agree, things can be done within deadline, but here is the question for you - what if it takes more time than you anticipated ? U r thinking ahead, so be prepared. Hi My baby was born on Dec 8 2010. He got the PP by Jan 8 2011. His PIO card took another couple of weeks. All in all 6 weeks. They proceeded to India in Feb 2011.
LuckyBaby Posted July 2, 2013 Author Report Posted July 2, 2013 Thanks ge145 Can you/any one please let me know what I need to handle if it takes more than anticipated? Thanks,
ge145 Posted July 2, 2013 Report Posted July 2, 2013 Here is what I received from Travisa, when i applied for PIO for SF consulate. We hv received your application and it will be forwarded to Consulate. I called after 4 weeks with same message on website status, and the application was still with them. I had to wait for an hour to get some1 on the line with and find out whats going on. I know mine may be one of a kind case, but I didnt have deadlines to be met. Yet it took 5 weeks to get my kids passport back. Why cant you ask your company to extend your stay for few weeks to be in better hands.
JoeF Posted July 3, 2013 Report Posted July 3, 2013 Be prepared to file for a COS to B2 if things take longer than expected. And @ge145: The OP is maxing out the L1, his company can't extend anything.
LuckyBaby Posted July 8, 2013 Author Report Posted July 8, 2013 Thanks for your help. I will check with my company whether they can apply B1/B2 for me? Please let me know what I need to take care in case if the processing takes more than anticipated. Thanks,
