amitarora4 Posted June 27, 2013 Report Posted June 27, 2013 HiI had a H1b petition which was filed in 2006 and expired in 2009. I had got my H1B visa also but never travelled against it. The visa got expired in 2009. I understand that the Visa can be reapplied and doesn't count under the cap, if someone already travelled on the same. My question is that can I use the expired petition to file for a new H1B petition, though I never travelled on the same.Thanks, Amit
pontevecchio Posted June 27, 2013 Report Posted June 27, 2013 I believe you can. Of course your H1 sponsor needs to file the petition and not you. Spend some money on a Lawyer so that you can speak to potential H1 sponsors from a position of well informed strength.

Can you please help me understand what kind of questions I should ask from Lawyer, so that it may help me in negotiating with the H1B Sponsors. Also, it would be great if you can refer me immigration Lawyer contact, I am ready to pay the reasonable fees (from India) for his time. Thanks, Amit
