My friend got H1B through a consulting firm in Nov 2008 for 3 years and got stamped, but he didn't came to USA as he got a job in MNC in other country. Now he wants to come to US by applying H1B, here my question is does he comes under cap exempt or he needs to wait for next year H1 quota. Thank you for looking at it.
