sam1586 Posted June 24, 2013 Report Posted June 24, 2013 Hi Folks, I need your help in calrifying changing status from H1B to F1 to H1B. I have my first H1B approved this year for next 3 years. I have plans of doing further studies from the Spring Semester 2014. If I continue my studies then I will be on back on F1. Question is, When we are changing from F1 to H1, do I need to apply in H1B quota or anytime(like an extension). Thanks Sam
JoeF Posted June 24, 2013 Report Posted June 24, 2013 If you have been counted for the H1 quota and you don't have used the full 6 years, you are not counted again. An employer can file an H1 for you at any time, and you would get the remainder.
t75 Posted June 24, 2013 Report Posted June 24, 2013 You can apply any time for the remainder of 6 years
rahul412 Posted June 24, 2013 Report Posted June 24, 2013 Once your initial H1 is approved, your ext will be against the cap.
