zandu Posted June 24, 2013 Report Posted June 24, 2013 My employer started my EB2 processing few months ago. And looking at the current scenario, I don't expect to get the GC before 10-12 years. I am considering an immigration to some other country with good living standards and faster immigration process. My question is, if I take up citizenship of another country in next 6-7 years, can I come back to US and reclaim my priority date of 2013?
geethb Posted June 24, 2013 Report Posted June 24, 2013 Nothing is going to change since (if immigration reform does not go through even by that time), your chargeability would still be based on country of birth & not citizenship.
zandu Posted June 27, 2013 Author Report Posted June 27, 2013 @geethb I understand that chargeability would be based on my country of birth. My concern is if my application would still be valid even after a change in citizenship. I hope that they won't ask me to put a fresh EB2 application.
geethb Posted June 28, 2013 Report Posted June 28, 2013 Hi Zandu, This could be a tricky situation & you would do well to consult an attorney since this is not a regular situation
pontevecchio Posted June 28, 2013 Report Posted June 28, 2013 The application will still be valid. But why would an employer wait for you for all those years. He will look for others to work for him.
