shnkr Posted June 19, 2013 Report Posted June 19, 2013 Hi, My spouse is currently on H4 (dependent) visa. We had applied for H1 for her this Apr 2013 and it is currently being processed. Today the status has changed to "Request for evidence". Someone whom we know mentioned that she must not travel outside the US as the I94 number and the date information that was furnished while applying for H1 will change. So they asked us to preferably travel once the H1 process completes. Is that so? Will travelling now cause any issues? Thanks!
pontevecchio Posted June 19, 2013 Report Posted June 19, 2013 Travel will nullify the COS though the H1 petition will be decided on merits.

It's always better to travel only after the decision has been made to avoid immigration issues.
anusha_rao Posted June 27, 2013 Report Posted June 27, 2013 Even i was in the same situation. But i've been told strictly by my attorney that travelling during the H1 status pending might revoke your H1 processing. I went to my home country after the approval and came back safely. I advise you to travel only after the decision is made.
