Is that legal ? when asked about this he replied that he(employer) is paying for PERM and H1B. is it legal to take money from employee paycheck to pay employer taxes ? please help kun144

t75 Posted June 19, 2013 Report Posted June 19, 2013 Both employer and employee pay FICA (SS) taxes. You should have this withheld from your paycheck in 2 line items.

It seems that you have some weird agreement with the employer, probably a percentage agreement. Be aware that a percentage agreement is rubbish. You have to get paid a salary, at least the salary listed in the LCA. You have a copy of the LCA, do you?
