sachinsvt Posted June 18, 2013 Report Posted June 18, 2013 Hello, I have a valid visa stamping from company A and its valid till Oct 18 2013. I working with company C (there is another company B, with who I work in-between), want to visit India for 10 days. Is it okay to go and come back to US again. I did that in my past in 2008 and 2009. But I company told me, its very risky to visit on different companies visa. They will be stopping people and sending them back from the port of entry. It is true or just a rumor? I am confused and need your suggestion. If you faced such situation, please let me know. Thanks, Sachin

He had another company's valid visa, and told to get a visa with current company. I spoke to my company's attorney, he said - its upto the officer. If he want, then he can allow; otherwise he can deny as well. could you give some real life example? If someone faced this situation in couple of months. Thanks, Sachin
H1Slaves Posted June 18, 2013 Report Posted June 18, 2013 Sachin, I was in same situation in Jan 2013 when I went to India. At the port of entry the officer reviwed my visa and asked if Im still with that company, My answer was NO. So he asked for current company's I 797. He reviwed and sent me to a different room for further review/second interview. I had to wait there for an hour ( there were atleast 50 other folks for various reasons sent there) and then the Customs officer reviewed my file and said that everything was fine with my documents and let me go. His exact words were: "The other officer didn't know the rules and sorry for holding you here" So the point is, ITS completely OKAY to travel. If a new officer happens to review he might think something is wrong. So yes dont worry, it will be fine. BTW this was in SFO port of entry.

If he want, then he can allow; otherwise he can deny as well. Admission is NEVER guaranteed. But the law provides for using an old, valid H1 visa TOGETHER with the approval notice from the new employer. Lots and lots of people have done that. There are posts here and in other forums.
