kumar1224 Posted June 18, 2013 Report Posted June 18, 2013 I have filled for change of status from H4 to F1 visa for my wife but recently we received RFE asking for these information and/or documentation 1) Correspondence - Any Other Correspondence Evidence -Submit a letter why this change of nonimmigrant status is needed. Can any one provide the sample -The address provided in your application is not within the commutable distance of the school's location. provide an explanation to show how you will be able to attend school and submit evidence to support your claim. where as this commuting is not more than 2 hrs by drive. what should i need to mention as a reply whether she is going to shift near by place or she can able to drive but she doesn't have driving license yet other than learner's permit, 2) Employment- pay stub. current pay slips and a letter on a company letter head signed by an authorized representative mentioning about principal alien's (i.e my documents) continuation of employment as an H1-B non-immigrant with the current employer I have already submitted my H1b approval I797 form showing approved until June'14. ie my last 6 years term going to end, but i can continue my H1b extension as my I 140 got approved. On her I20 mentioned that her studies are for 18 months, which is not before June'14. Do I need to show that i can be on H1b extension with I140 approval or not. what content I have to request to my employer to mention in this letter. Please reply ASAP.

Stating reasons why she wants change of status, such as the ability to work on-campus, participate in authorized practical training etc. It should also mention how she has maintained residence in her home country. -The address provided in your application is not within the commutable distance of the school's location. provide an explanation to show how you will be able to attend school and submit evidence to support your claim. where as this commuting is not more than 2 hrs by drive. what should i need to mention as a reply whether she is going to shift near by place or she can able to drive but she doesn't have driving license yet other than learner's permit, -- She should simply write how she really plans to attend classes. If she plans to move there, a simple letter will do. Provide a letter from your employer stating that you work for them and provide most recent payslips. Also, add copy of marriage certificate, I-94 etc. It does not hurt to send the documents again. Please reply ASAP.
