gotoajau@gmail.com Posted June 17, 2013 Report Share Posted June 17, 2013 I am currently here on L1 visa with company 'A' which is valid till Nov. 2014.I have also applied for H1B visa which is approved from 1 Oct 2013 through Company 'B'. My current employer is asking me to go back on end of july. I want to resign and dont want to go back, please suggest me: 1 Can i stay in US during Aug and Sept after resigning from current company ? 2 How long i can stay in US before 1 Oct without job? 3. Is there any other way to stay in US for 1 or 2 month? 4. Can i go back and come back on L1 visa stamp and H1 pettion? Thanks. Link to comment
Attorney_23 Posted June 18, 2013 Report Share Posted June 18, 2013 Generally speaking, an L1 worker falls out of status as soon as s/he stops working for the L1 employer. There is no grace period or immigration benefit afforded based on a future H1B start date. An L-1 visa may not typically be used to enter the U.S. in H1B status. (Although, there is this notable exception to that rule: Contiguous Territory Rule Permits Reentry from Canada or Mexico.) Link to comment
