H1B VISA stamping (Company acquistion scenario)

Hi,

I am a FTE employee of CompanyA since March 2008. I got my first H1B stamped in Dec 2008. My first H1B extension is valid till Aug 2104. I also have an approved copy of I-140 from Company A. In Dec 2012, my company got acquired by Company B. Per the immigration laws no H1B amendments are required since the new company has assumed the legal responsibilities and there is no change in the business operations.

I am planning to go for my H1B stamping in the near future and I have the following questions that I would like some clarification:

-If the VO asks, how long I have been working with my "current" employer, do I mention since Dec 2012 (or) since March 2008?

Note: My current employer has actually honored our previous tenure with the old company. So, technically I have not changed jobs since March 2008.

But I doubt if the VO understands this and hence the confusion.

-I am also a little skeptical about DS-forms, do I mention new employer (or) old employer info?

-Also, my title has changed but the job responsibilities are exactly the same. Does that have any negative effect?

i was in the same situation and done with stamping recently.

A) March 2008

 

Q) I am also a little skeptical about DS-forms, do I mention new employer (or) old employer info?

A) In My case I have entered New Employer Info as i have done amendment last month (If you have not done Visa extension or amendment after Dec 2012 still I think you need to give New Employer info as it is printed on Visa stamp if it is approved and anyway your employer letter now is on new company name.)

I would suggest Check with your employer and attorney as well.
