H1B extension beyond six years while labor is audited

Hi,

 

My labor was filed on 10-31-2012 and got an audit on 02-20-2013, my 6 years of H1B is expiring on 12-25-2013. Can I file my H1B extension on/after 06-25-2013 or do I have to wait until 10-31-2013 (365 days since pending labor) to file my 1 year H1B extension in case my labor does not get denied.

 

Can you please let me know if I am eligible for H1B extension for my case and when is the latest I can apply. And what are my options if my labor gets denied.
