F2 to F1 during grace period

Hi, 

 

I'm a F1 student who has finished OPT on 5/20/13. I was not selected in the H1B lottery this year. 

My wife is on F2.

We are now on the 60-day grace period which expires 7/19/13. 

She would like to change status to F1. 

I'm wondering if she can file i-539 in the US w/o leaving the country during the grace period. (We have an infant, it is difficult to go back now).

 

What are the odds for the i-539 to be approved?

I would just file and then see.

In my opinion, I would not recommend I-539. It is wise to go back and come on H1 thru any consulting companies from base country.
