pranam Posted June 8, 2013 Report Posted June 8, 2013 Hi, I was working with client A through Indian consultancy company B in State New York. I quit the company 14 months back. I am currently working with company C and client D. Recently I got an offer from my first client Company A. As per the non compete agreement with my previous employer Company B I have to take written consent before providing any kind of services to there clients ( Company A) for period of 2 years from the date of termination. It's only 13 months since I quit my previous job. Can you please suggest how should I process in this case? What will be the implications of breaking this agreement? Thanks for your help.

t75 Posted June 10, 2013 Report Posted June 10, 2013 You and/or your employer can be sued. Your employer should have been advised of this when you were hired so they would not have tried to place you in violation of the agreement. You and/or your employer could try to negotiate payment to your original employer to compensate him for your breech of contractual agreement.
