l1visastatus Posted June 5, 2013 Report Posted June 5, 2013 Hi, I am currently working in US on L1-B Visa. My petition validity, I-94 Expiry Date and Visa Expiry Dates are all April 9, 2014. However, my 5 Years of physical stay is valid only till July 12, 2013. My Company is trying to get my Visa converted from L1-B to L1-A in the US. However, since only 4 weeks of time is left for the 5 year physical stay to get over (by July 12, 2013), I am not sure if the conversion can happen during this time frame? Also, if my L1-A gets approved, what would be the validity on my L1-A? Please note that my company also have L1-Blanket petition approved, but they dont want to go with that option and rather wants to file for me L1-A individual petition. I have been on a managerial position for the last 2 years, but the status from L1-B to L1-A didnt get converted because of certain organizational changes. Could you please advice me on my case here? Thank you.
Attorney_23 Posted June 11, 2013 Report Posted June 11, 2013 In general, a change of status from L1B to L1A must be approved by the USCIS at least 6 months before the worker reaches the 5-year maximum time limit. Am I correct in assuming that your employer is not using an attorney to file this petition?
