mih Posted June 4, 2013 Report Posted June 4, 2013 Hello, I recently received my i140 approval , wanted to know the below, I see many different responses on this so got a bit confused. 1) Is it possible that i can change employer based on just Receipt number, keeping my PD. 2) Can the employer cancel my i140 in case i jump the job (negating fraud condition). Ricky27 Posted June 6, 2013 Report Posted June 6, 2013 Though your previous employer cancels your i140, your PD is still valid. If your i140 is cancelled because of some fraud, then your PD will not be valid.

ge145 Posted June 6, 2013 Report Posted June 6, 2013 if u change ur job, ur old employer may cancel I140, reasons could be any - including fraud If it is fraud, you cannot retain Priority date (PD) If it is not fraud, u can retain PD, but have to restart new process - file labor, then file for I140 asking to retain old PD. In many of the cases, new employers do ask for some timeframe to work in the company before they initiate the process of GC.

If I have a approved I140 from an employer X, but I changed the job and joined the Company Y now. And its been around less than a year working for Company Y. If i decide to go back to my previous employer X and join him back, will my approved I140 from his compnay will still be valid?? Do I need to go through the labor approval again with Employer X as am joining newly with him after a gap of one year?? Please let me know.. Thanks, RI
Belle Posted June 7, 2013 Report Posted June 7, 2013 The I-140 is generally valid while you have a job offer from the employer. There is no obligation to work for the employer until the green card is approved.
