Hello

I'm working for a company from past 2.5 years and recently they have processed my H1B with the 15months contract, if i leave the company i have pay every month $800 until the contract ends according to the written agreement. My H1B will start from Oct 1st 2013.My concerns are the company is not giving any hike since i joined they didn't even increase my salary ,No promotions etc..When i ask my HR about the pay they are just ignoring .Can i break contract and join other company ?Will i face any legal issues if i leave the company .Please give me your suggestions.Thank you

No company is required to give an employee a raise. It is only required to pay the employee according to the labor certification for the position for which the H1B was filed.

Some employment contracts are enforceable. Only an attorney (not necessarily an immigration specialist) can advise you about what you signed. If you did not like the terms of the agreement, you did not have to sign it, but you wanted them to file for the H1B for you which cost them a significant sum of money. You should always have a contract that you do not understand reviewed by an attorney BEFORE you sign it..
