anandan@anandans.com Posted June 4, 2013 Report Posted June 4, 2013 I have applied for H1B visa in 2008 (2009 quota), selected in lottery and I got the petition approved but I didn't go for stamping due to the personal reasons. Now I heard from my friends that I can still use my I-797 and get my visa processed as its an unutilized quota of mine. Can you confirm me whether I can get my visa processed? if so, will it be easy for any company to transfer my I-797 to their name when the current employer (who applied in 2008) is not ready to process my case. wiweq Posted June 4, 2013 Report Posted June 4, 2013 Yes, any company can file cap-exempted H1b for you. They should have legal work for you in USA. If you never been to USA on H1b, you still have 6 yrs on your H1b quota.
