manirajp Posted May 28, 2013 Report Posted May 28, 2013 Hi, Looking for help to suggest me whether I am eligible for L1B extension or not, based on the below circumstances and 5 year eligible period. 1. First L1B Term - Mar 2008 to Mar 2011 I stayed out of US for 11 months during this period but not continuously. 2. Second (New Visa not the extension) L1B - Mar 2011 to Mar 2014 I stayed out of US for 2 months till now. My I94 expires in Mar 2014. So I will be completing close to 5 years of my stay on L1B when combining my first and Second L1B. Questions: 1. Will I be eligible to apply for L1B extension by considering that I was not in US for 13 months? I heard from forum that after completing 5 year quota in L1B, if person wants to work in L1B, he/she should be out of US for one whole year. 2. Is it legal to apply L1B extension based on current (Second term) L1B? 3. Even I apply for L1B extension based on my current L1B, will I face any issue in future when applying for H1B or Green card? pontevecchio Posted May 31, 2013 Report Posted May 31, 2013 Once you leave for one year the company can file for a new L1. In your case I doubt you are eligible for an extension. Ask your HR .
