santiR Posted May 27, 2013 Report Posted May 27, 2013 Hi, I entered US as a visitor , as I had my H1B approval(No H1B-stamping in passport) from previous company. After I moved to US, I got full time job, and they filed(/transferred) my new H1B. My I94 says (it was on B2) its valid only till Jan 20th 2013. I got my I-797C form from my employer, which valid till 2015. When I see on https://i94.cbp.dhs....94/request.html my I94 says only about B2(Jan 20th 2013). How can I get new I94. I am confused, whether my stay is valid or not. My employer is not giving me the I797A, they say they don't have it. please let me know how should get my I-797A or new I-94? thanks SantiR
omshiv Posted May 28, 2013 Report Posted May 28, 2013 You should first talk to an Attorney today itself and probably pack your bags and leave the country and come back...also your employer should give you 797 petition....I believe it would be a 797B.
t75 Posted May 28, 2013 Report Posted May 28, 2013 Since you were on B2 status, you should cot have begun working without an H1B I-94 in your hand. Exit and get stamping and reenter is the fastest way to get a valid i-94 since your employer does not have it.
pontevecchio Posted May 28, 2013 Report Posted May 28, 2013 Either tals to the Federal DOL ASAP or talk to a Lawyer. First ask him to show the relevant I94 and if he refuses do the above.
