I came to US on H1b visa for a indian it comp last year and still with them but given my resignation and will be relieving this month. I got a offer for contracting and joined a consulting company B for which I got my H1b transfer approved last week. Now I got a full time offer from another company C, but the thing is they will not be able to process or even file the transfer before this month end. I want to join company C now. What should I do ? Can I join the company B and then initiate a transfer from them to the full time company. but in that case I will not have a payslip before 1 month. Can I initiate a transfer before I get the first payslip from the consulting company ? Also Is it possible that transfer gets rejected since I will have only one payslip from the new consulting company in a month ? Please advise.
pontevecchio Posted May 27, 2013 Report Posted May 27, 2013 Tell B that you have to go back home for 2 months and then get a H1 visa as appropriate and join C if that petition is approved. Hopefully no visa avoidance? If you have a valid H1 visa stamp now you can use that to come back.
