Ksr_0810 Posted May 24, 2013 Report Posted May 24, 2013 Hi All, In 2010 my H1 visa at hyd consulate was denied due to in-house project . This petition was filed by ABC compay in US. Later I came to US on H4 visa in 2012 and transferred my H4 visa to H1 visa ( used old H1 petition which was filed by ABC company in 2010) to another XYZ employer. Today I received a mail from USCIS stating that my old visa petition is denied. Will this have any effect on my current H1 visa. As said old petition is with ABC company and I got it transfer to XYZ company. I'm still on pay roll of XYZ company since almost one year. I informed my current employer but he is yet to come back on this. Please post your comments. Regards, Srinivas Reddy
pontevecchio Posted May 25, 2013 Report Posted May 25, 2013 Petitions are not physically transferred as you seem to imply. Every new employer files a new H1 petition. You would seem to be fine.

People always use the term H1-Transfer in a misleading way...Nothing gets transferred. Also I am not sure how you have used your petition from ABC, it's never used, you must never have had any pay checks with them...
