gchoubis Posted May 23, 2013 Report Share Posted May 23, 2013 L1B expiring on 4th July 2013,applying for extension(Want to go to India in July and come back in 1 month);so that I can maintain status till Oct 2013. Also, applying for H1B through an employer and for that I have got the receipt number. While filling for DS160 for L1B extension,there is a question "Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?" Should I answer yes?...If yes, then what explaination should I give so that visa interviewer doesnt raise his eyebrow considering the fact that I'll be appearing for L1B visa stamping interview and then later appearing for H1B visa stamping interview as well. JoeF Posted May 23, 2013 Report Share Posted May 23, 2013 An immigrant petition is an I-130 or I-140. If your employer has filed an I-140, you have to say "yes" there, if not, then "no." Link to comment
