H1BExtension2 Posted May 22, 2013 Report Posted May 22, 2013 Hi All, My H1B Extension from India has been denied based on the Employee and Employer relation ship. I am working for a company from the past 3 years in india and the client has a relation ship with My company from past 8 Years. I am having proper client letter, SOW, etc all the required information. But my case has been denied by INS saying that the documents shows that I am an employee of my client not the company that I am working for. Can anyone suggest me how can go forward with this? Thanks in advance.
omshiv Posted May 22, 2013 Report Posted May 22, 2013 you got a straight off denial or first a RFE? a straight off denial could mean worst...talk to an Attorney today.
H1BExtension2 Posted May 23, 2013 Author Report Posted May 23, 2013 Hi Shiv, Thanks Shiv. As per my employer it was an RFE first and then it was denied. They also say that this information usually will not be shared with employees. Can I have the opportunity to Apply with the same client?

If you can work with client directly, then that's the BEST option you got. Its clear that your employer didn't responded to the RFE in such a way that petition will get approved.

What I meant was can My company apply for an H1b Extension with the same client letter? And also My employer said that we got denial not sure how it works. Can throw some light on this?

It ALL depends on what that letter says. As a employee I think you doesn't have access to those documents. So if your employer's client letter is not good enough, then find another employer who provides strong documentation to support your case.
