nageshsqlserver.bi Posted May 22, 2013 Report Posted May 22, 2013 Hi, For some reason my H1B got approved for only year whih out any RFE. I am working for an consulting company Employer-vendor-client Q 1) If I apply for next year extension do I get approval for only one year or I will be getting 3 years Q 2) If I start my Green card processing and get my I140 approved by next year do I get extension for 3 year when I apply for extension next year or It does not matter if I apply for Green card processing. Q3) What is the best way to get 3 years H1B approval Thanks In advance.
rohang Posted May 22, 2013 Report Posted May 22, 2013 1) It depends on project, its not a compulsion that H1b duration is 3 yr. 3yr is a max limit. Duration depends on the assignment visibility (mentioned by company while filing H1b). 2) same is true even after I140.
omshiv Posted May 22, 2013 Report Posted May 22, 2013 Is this your H1 extension or your first time H1B? Also extension might have been based upon the time shown on the Client letter.

pjagadish86 Posted May 22, 2013 Report Posted May 22, 2013 I showed as long term project on the client letter not sure why only one year any comments on this No one can assure for 3 years limit. It all based on PO or Client duration exact dates. USCIS wieghs based docs and also lttle luck plays. Good luck for extension.
rohang Posted May 22, 2013 Report Posted May 22, 2013 I showed as long term project on the client letter not sure why only one year any comments on this again, its not a compulsion. 3) Next time your documents go for extension/change, as your employer to send PO/Visibility document with 3 yr period. This is a only way. Why you are so worried with duration? till you will have project, you will get extension, and H1 fee is paid by employer so it should not even be your concern.
