MyProfile Posted May 21, 2013 Report Posted May 21, 2013 My employer filed H1B for me this year(2013) and mine got picked in lottery. However, my project completed last week and now i'm looking for a new one. Now my question is if I get a new project in a different location should my employer file new LCA or can he use my old LCA with my new project? what are my chances of getting H1B approved?
Jyothis Posted May 21, 2013 Report Posted May 21, 2013 When my H1b was processed and approved, I didnt have any project in US. So, leave it to USCIS to decide if you are eligible to be an H1b worker in US. You just need to make sure that once approved, get it stamped ASAP and get here before the stamped visa expires. Best of luck!
Jyothis Posted May 21, 2013 Report Posted May 21, 2013 On LCA, Your employer will need to update it when your project comes through - make sure that they do it and ensure that your LCA matches your work location, as there are enough horror stories for having it not updated. Stay legal, stay here.
MyProfile Posted May 22, 2013 Author Report Posted May 22, 2013 Hi Guys, Thanks for your replies! Now I got a new project in Richmond, VA and my H1 was files when I was working in Florida. So do I need to submit a new LCA with Richmond, VA? I still have not received any query for my application so would you recommend wait till I get a query to update LCA?
0407 Posted May 22, 2013 Report Posted May 22, 2013 If this is a new CAP subjected H1B, then you can not change the LCA when it is under process. Good Luck to you. I wish and hope USCIS doesn't send an RFE
