xusmee Posted May 20, 2013 Report Posted May 20, 2013 Hi all, I have my father visiting me here in the US (visitors visa) and I plan to file for my father's GC but I was not sure if I need to wait 90 days while he's here to start the process? Any inputs or someone wishes to share their experience will be useful. Regards,
pontevecchio Posted May 20, 2013 Report Posted May 20, 2013 There are some time restrictions and you should really have a lawyer file. You should probably wait to see what happens to Health Care reform and file his GC for CP to give you more breathing room.

In this case, after an I-130 approval, the person who is abroad would get an invitation to the US Consulate, and would bet an immigrant visa there, which the person then uses to enter the US and become a Permanent Resident at the border.
