H1 RFE Suugestion

Hi ,

I am working on a contractor for a federal govt agency.

I filed for an H1B amendment as I changed my end client and also wanted to go H1B stamping in near future. My H1B Amendment petition has been RTFed by USICIS asking for a valid employer to employer relationship.

End Client ------------------------------ Federal Govt Agency located in Washington DC

Implementor/Prime Vendor ------------ An American Company located in Virginia

My Current Employer ------------------ Located in Texas

When we filed for the H1 Amendment, we could NOT get the Client letter from my end client. In addition to this, we could NOT provide the PO/Contract Agreement between End Client and the Prime Vendor.

All we had at the time of filing for the H1 Amendment was a letter from the Prime Vendor company that I have been working at their federal client agency at the Federal Govt office in Washington DC.

My end client is not willing to provide any kind of Client letter or an email stating that he cannot provide any letter because of the Agency policy.So, basically I have nothing from my end client to show/prove that I am working at that Federal Agency.

Now my question to the experts is, weather or not it is a good move for me to jump from the current company to the prime vendor to by-pass myself from this RFE issue ?

If I moved to the Prime Vendor , then they could show the PO/Contract Agreement between End Client Federal Agency and the Prime Vendor( Future current company). How ever, I would still cannot get the Client letter or email from end client stating that he could not provide any client letter to the contractors.

Can you please suggest if moving to the prime vendor would be the right thing to do in this current situation. Thank you.

Alternatively you can take the email from your client manager which explains that they cannot provide the client letter and take the time sheets screenshots which you filled at the client website and some email which explains about your work, so that you can respond to your RFE.

Client letter is one of the req documents for H1 approval.

Its time for you to find another employer without layers in between.

Thank you for your reply. My Client is pretty strict and could NOT even provide an email that they cannot provide the client letter.

I guess, all I can show is company's portal page where my name and photo is listed.
