Currently I'm in L1 and my project is getting over by August 9th . As per my company policy i have to flyback to India once my project is complete,I am thinking of resigning after august 9th and stay in US till OCT 2013 to get my H1 petition valid. My concern would be whether i can stay in US for 2 months with valid I-94 till Oct-2013,because my company will cancel my L1 once i resigned. Need you suggestion. Thanks.

SameerH1Bworker Posted May 20, 2013 Report Posted May 20, 2013 Once your company stops your payroll, you'll be considered out of status, better to go back to india then staying with out of status.
pontevecchio Posted May 20, 2013 Report Posted May 20, 2013 What gives you the impression that the H1 visa with the new employer would be a problem? Just make sure that they provide all documents necessary.
