gigi123
I went out of country last year , my H1 Visa stamped on my passport was expired and I entered US with an AP, I hold a H1 petition valid till Dec 2014 -I-94 was stamped for 1 year i.e Aug 2013 -I continued to work on my H1 -I have an EAD/AP renewed/valid till Feb 2015 now I talked to the attorney about my I-94 expiring and next steps, they say I have to extend my H1 to be able to work after Aug 2013. Is this right as I was reading in forums by some that you don't have to do anything with I-94 1. Can I keep working on H1 status till Dec 2014 without renewing I-94 2. If I-94 needs to be extended whats the process. 3. What happens to the H1 work authorization if I travel out of country and re-enter using AP now. Please shed some light. Appreciate any responses Link to comment
pontevecchio
Why in tarnation are you not using the EAD to work? What is so sacrosanct about maintaining H1 status? Link to comment
Chandana123
Mine is a similar case, Currently am with employer A and travelled to India unexpectedly. While I am here, employer B filed H1 B transfer and have got the approval. Now, I am travelling back to US ( with valid stamping of employer A) Q1. Do I need to show the employer B H1 B approved documents during Immigration? Q2. Do I need to work with employer B from day one if I show the employer B docs during immigration? Link to comment
pontevecchio
1. You need to show the H1 approval for the company you will work for on return. 2. No. But you cannot work for A for even one day. You have 30 days to report to B. Link to comment
