hobbit007 Posted May 16, 2013 Report Posted May 16, 2013 I am in my 12 month OPT period. I am looking to renew my opt under the provision of " Self-employed business owner: Students on OPT may start a business and be self-employed. In this situation, the student must work full time. The student must be able to prove that he or she has the proper business licenses and is actively engaged in a business related to the his/her degree program. " The business is a website and related to my field of study (computer science) I plan to either shutdown or sell my business when i change to H1-B in the future. It is not an attempt to fake legal presence in United states but a genuine effort to start a business related to my degree. I have a complete plan and an end goal. Here are my steps -Start business as sole-proprietor ( do i need to form an llc ?) -Acquire any required business license -Enroll for e-verify (since this will be OPT Extension) -Apply for OPT extension with this e-verified business The school has no issues in generating the new I-20 for OPT extension. I want to check if there would be any immigration issues at present or in the future because of this. (rfe, re-entry, future gc application etc. ) Thanks p.s. on a side note, i also have an H1-B Change of status approved from a top tier employer (former) which will be revoked soon.
