My employer talked to customer service and they say that each year they select more than cap count and send receipts to all those cases. if cap count is met with all valid cases then these buffer cases will be closed. Is it true?? Will they select more than 20000 for masters quota and more than 65000 petitions for general quota. And send receipts to all those cases which were selected. without informing that yours is a buffer case. After few days will they close these extra cases?
JoeF Posted May 17, 2013 Report Posted May 17, 2013 They select more than the cap count, in case some selected H1s get denied, so that they can fill the slot. But they only send receipts when an H1 petition is actually accepted for processing. That's why some people haven't heard anything about their H1 yest, no receipt, and not returned yet.

When my employer called and asked USCIS, they said that mine was not selected in the cap limit and informed my employer that they are refunding those checks. Is there anything that I can do?
