vamsi2280 Posted May 16, 2013 Report Posted May 16, 2013 I am currently working in USA under L1A visa which is going to be expired on September 19th 2013. However, I have my H1B for 2014 got approved and my I-94 for H1B is valid from October 1st 2013. So, Can I stay in USA for those 11 days between Sep 19th to Oct 1st ? Or Shall I need to go back to India and get my H1B Stamped? If I can stay back in USA, is there anything else need to be done from my side? Please advise.
pontevecchio Posted May 19, 2013 Report Posted May 19, 2013 When does the L1 I-94 expire? Secondly ask the Lawyer involved as the USCIS may have decided to ignore a couple of days.
buntyl1 Posted May 25, 2013 Report Posted May 25, 2013 Hi, I applied for L1A to H1 B transfer in Cap exempt but unfortunately my H1 got rejected. My questions are 1. Can i stay in L1 now? 2. If i want to extend my L1A in future, do i need to mention H1 denial to USCIS? Can anyone help on this? Thanks
pontevecchio Posted May 27, 2013 Report Posted May 27, 2013 1. Yes, if you still have the L1 job. 2. Since the company alone files a petition extension the question is moot. If you are ever asked you have to mention the truth.
buntyl1 Posted May 28, 2013 Report Posted May 28, 2013 Thanks. I have seen the I129 form. There is a question about denial like this.. Ever been dened the classification you are requesting? As this is L1, do i need to mention H1 denial during L1 Extension. Can anyone advise? Thanks in advance
