vg123 Posted May 15, 2013 Report Posted May 15, 2013 My current H1B I797 document is valid is Dec 2013 . But the my actual 6 year period is valid only till July 2013. It seems that USCIS has mis calculated my 6 year period and has given an approval till Dec 2013. My PERM has been filed and is Audit status. This is the general audit to provide clarification on recruitment and statement that the employee did not pay for the GC processing. 1. Is there a cause of concern that USCIS has provided and extention till Dec 2013? 2. Can I continue to work till dec 2013 or should I convert to H4 status in July 2013(i.e when my acual 6 years end)
JoeF Posted May 15, 2013 Report Posted May 15, 2013 They sometimes make mistakes. Don't try to benefit from their mistake. They will find out eventually, and if you worked longer than the 6 years, they may declare you out-of-status retroactively.
t75 Posted May 16, 2013 Report Posted May 16, 2013 Do not attempt to take advantage of an error by USCIS. You may work no longer than 6 years on normal H-1B.
