matarese Posted May 15, 2013 Report Posted May 15, 2013 Had filed a complaint with DOL against my former employer and won. Awaiting details of 'settlement' being done between DOL and employer. http://forum.murthy.com/index.php?/topic/14698-dol-whd-complaint-filed/ Long since moved to India and settled for good. Now the question is how I will be taxed since I will receive payments in India as non resident alien. Request anyone who had a similar experience to share theirs. Thanks.
0407 Posted May 15, 2013 Report Posted May 15, 2013 Hi, I know someone who wants to fight with employer. Did DOL representative call you or did you communicate over email?
JoeF Posted May 15, 2013 Report Posted May 15, 2013 Hmm, good question. This is back pay, so the normal employment taxes should apply. You may have to file a 1040NR next year.
matarese Posted May 16, 2013 Author Report Posted May 16, 2013 Hi, I know someone who wants to fight with employer. Did DOL representative call you or did you communicate over email? Did speak to the DOL rep a couple of times when there seemed a delay in process. Otherwise right from start, all communication was on email. Ask them to collect all evidence including every email between them and employer.
