kennedy Posted May 14, 2013 Report Posted May 14, 2013 Hi , I am on H1B. I got my Visa stamping done 8 mnths back . I was with employer A. I moved to employer B.(they are sponsoring my GC) Now my wife will go for H4 visa stamping. My Employer A gave employer verification letter with salary of 60lK according to LCA. Will it be a problem with less salary? If VO asks why i moved from employer A to B ..what should my wife answer?
rahul412 Posted May 15, 2013 Report Posted May 15, 2013 Now my wife will go for H4 visa stamping. My Employer A gave employer verification letter with salary of 60lK according to LCA. Now you are working for B. So why do you need A's letter?
Attorney_25 Posted May 15, 2013 Report Posted May 15, 2013 A spouse is eligible to be issued an H-4 visa if the principal spouse is properly working in the US according to the terms of an H-1B petition. It does not have to be the same H-1B petition/employer that the H-1B spouse has at the time his H-1B visa was issued. It is important to be honest with the consulate in all respects during the H-4 visa process.
kennedy Posted May 16, 2013 Author Report Posted May 16, 2013 Now you are working for B. So why do you need A's letter? sorry the letter was from my employer B
kennedy Posted May 16, 2013 Author Report Posted May 16, 2013 can my wife inform VO that employer B is sponsoring my GC?
rahul412 Posted May 16, 2013 Report Posted May 16, 2013 can my wife inform VO that employer B is sponsoring my GC? If vo asks about GC and if that is true then she can.
kennedy Posted May 17, 2013 Author Report Posted May 17, 2013 If vo asks about GC and if that is true then she can. thanks sanjay...but i dont have any supporting documents to show that my GC is filed.
pontevecchio Posted May 18, 2013 Report Posted May 18, 2013 Since H1 and H4 is considered dual intent it makes no difference as to what she answers as long as it is true.
