bellevueranger Posted May 14, 2013 Report Posted May 14, 2013 Are there any rules, actual or otherwise, that restrict me from applying for my first time L1B visa in a consulate (Dublin) out of India?
Guest Noah Lotte Posted May 15, 2013 Report Posted May 15, 2013 you can always apply, but getting approved may be more challenging...especially if you entered the US with the ever popular B1 'knowledge transfer' visa, then miraculously changed status...I would expect a lot of scrutiny, perhaps even a 221g refusal while our folks in India investigate your entire 'employment' history.
Attorney_23 Posted May 15, 2013 Report Posted May 15, 2013 Are there any rules, actual or otherwise, that restrict me from applying for my first time L1B visa in a consulate (Dublin) out of India? Per the U.S. consulate in Dublin's website: We will accept visa applications once you are physically present in Ireland and make an appointment through the Visa Information Service. It is essential that you be prepared to wait at least three business days for the processing of your visa and the return of your passport. For example, applications/passports received on Monday should be delivered by mail on Wednesday. While passports should be delivered within three days in the vast majority of cases, we do not assume any responsibility for longer delays. We do not deliver passports to addresses outside of Ireland. It is essential that you arrange an address in Ireland for the return of your passport. Should you plan to depart Ireland within the three days required for visa processing, it is your responsibility to check with transport carriers on documentation required for travel. Non-residents must follow the same application procedures as residents for a nonimmigrant visa, and you must provide sufficient postage for the return of your passport by mail. Note: There is no guarantee that your visa will be issued. Should your visa application be denied you would not be refunded the visa application fee. you can always apply, but getting approved may be more challenging...especially if you entered the US with the ever popular B1 'knowledge transfer' visa, then miraculously changed status...I would expect a lot of scrutiny, perhaps even a 221g refusal while our folks in India investigate your entire 'employment' history. Belle had a very simple question. Nothing in his posting even hinted at applying for a B-1. And, given that this was Belle's first post, there is absolutely no reason to be suspicious of his 'employment'. This forum is intended to help foreign nationals, not to cast suspicion and espouse cynicism towards all foreigners, no matter how banal the question.

Thanks for your answers. Just to be more clear I have worked in US on H1B for 5years previously and about 2 years ago moved to Dublin.
