sara88 Posted May 14, 2013 Report Posted May 14, 2013 I am PhD student in legal status. My passport expires in July 2014 and my I-20 expires in January 2014. My school has made it clear that they will extend my I-20 since I still have some research left to do before I hand in my thesis.My F1-visa stamp expired in Dec 2011 I am considering applying to renew my passport at the SFO consulate this September, about 10 months before my passport really expires. My question is: will I need to turn in a "no status affidavit" (http://www.blsindia-usa.com/forms/affidavitFillingInstructions.pdf) to the consulate since my F1 visa has expired even though my I-20 is valid? The form makes it seem like it is applicable only in instances where a person has lost legal status in the United States or has failed to apply for a new passport in time, and I am certain I have not done either. The instructions on the BLS website do not make it clear if they consider valid status as F1 visa validity or I-20 validity. I've tried calling BLS but no one really answers the phone. I'd appreciate any insight on this situation. Thanks in advance.
