Should me or my Mother apply for my sister?

I'm a 41 yr old US Citizen. My mother is a Permanent Resident and is 70 yrs old. My 42 yr old sister now wishes to come to the states. Is it better for my mother to apply for her or is it better if I do? If my mother applies what happens if she passes away after the I-130 is filed?

Also, with all these proposed changes, is it better to wait and see what the new laws do or is it better to apply now?.
