H1 Amendment

Hi All,

My Employer has applied for H1 Amendment last week in premium processing. And i'm travelling to india on May 21 and has visa appointment on may 31 as of now. I'm hoping i will get the Approval before i leave to India but not sure about the approval notice. Please let me know how long does it usually take to get the approval notice. Also in anycase can i attend the interview with out original approval notice(Amended petition approval notice). I have the original I797 which valid thru Nov 2015

It takes about a week to get the approval notice by mail.

1. Its 15 days for pp

2. you need a copy of approval notice for stamping.

3. if you go by old pettion its misrepresenting to vo (as you are updating so called "material change" on old pettion)

contact attorney for further verification.

You could hear the approval from Uscis but its hard to receive the approved i-797 from your employer to you.

You can only go with New Amended notice.

Try to get your documents mailed/sent by some one before your interview in India.

But everything looks complex. Better to reschedule the appointment to have a safe interview with all documents.

Can I go out of the country without original notice..but ask them to mail it to me (India)?

Immigration team POC says i can go to visa stamping with the current approval notice and carry the copy of Amended petition. As she is not sure if i will receive the amendment appoval or not before my visa appointment. she says technically amendment is not required and they just filed it to make things easier for stamping. All i need is updated LCA. which they updated long back. Please suggest if it is ok to travel as per the companies immigration team.

how about vo doesn't have any idea what you said? why taking a risking when you have time.. y make things worse. consult attorney.
