pentium Posted May 12, 2013 Report Posted May 12, 2013 Hi Folks - Need your expert advice! Facts: -> 6 years of H1B ( extension ) expires in August 2014 -> i140 (in EB2) approved from employer A ( say current employer ) -> Applying H1B with employer B ( say new employer ) -> Employer B plans to file my H1B sometime this month and PERM in Fall 2013 ( wish I knew which month ) Concerns: 1) What happens if my new PERM is not approved before AUG 2014 ? ( I know its unlikely if they file it on time but still would like to know about this scenario ) 2) What happens if my new PERM is approved before AUG2014 but i140 is not approved ? Can I still get H1b extensions ? Recommendations ? -> If any one of you have been in similar situation or have knowledge about this topic, I would really appreciate your inputs of don't and do's. Thanks in advance!! :)
immigration_wanderer Posted May 22, 2013 Report Posted May 22, 2013 Hi , I would like to know the question to your answers as well, but i have a basic question. Since your I-140 eb2 is approved from Company A you can keep on getting the H1-B extension for 3 years based on that approval right ? Are you saying that the extension is only given in case when I-140 is approved with the same company who is applying for extension ? I am not sure of the answer would like to know if you can make the question more simpler.
