PhD on F1,convert to H1B

Hello,

My name is Shiva.Currently My company has applied for a H1B this year and I have a receipt.I am working here as a Full time employee.My current visa status is F1-OPT-17 month stem which is expiring this November.I have got an offer for doing my PhD which I am going to accept in same disciplines -CS in which case I need to tell my current employer to cancel my H1 they have filed.The University where I have got an admit has not sent a I-20 since they want a sevis transfer from my current university with whom my current sevis is held with.

If I take up my PhD and in future if I quit due to unforeseen circumstances,how can I get an H1B maintaining a legal status without going out of the Country?

If by chance,I get approved for H1 this time and then I tell the company I am quitting the job,will this maintain the legal status for the above question?

If you do not intend to honestly pursue your H1B (questionable since you are already looking at a way out), do not prevent another real student from having the position.

You may be liable for damages to your employer if you do not appear for work depending on your contract with your employer.
